Probation is often sold as leniency, but in practice it is one of the most invasive and least understood forms of punishment imposed on our clients. This course examines the real-world operation of probation in Arizona, breaking down standard and specialized probation terms and how they are routinely interpreted, and weaponized, against our clients. Attendees will explore the breadth of probation officer discretion, the lack of meaningful oversight, and the recurring ways probation practices erode constitutional and statutory rights. The course emphasizes practical defense strategies for counseling clients, challenging unlawful conditions, and responding to alleged violations.
